Terms of Service

These Terms govern your use of totosbotanica.com(the “Site”) and any purchase you make on it. The Site is operated by Sanya Garg, who runs Toto's Botanica as an individual seller based in Pune, Maharashtra, India(“we”, “us”, “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Our products

  • We sell handmade flowers made from pipe cleaners and beads: ready-made designs, bouquets, arrangements, and custom pieces.
  • Every piece is made by hand, so small natural variations in colour, size, shape, and finish are normal and are not defects.
  • Colours may look slightly different on your screen than in person.

2. Prices

  • All prices are in Indian Rupees (₹).
  • Delivery charges are calculated from your PIN code and the size of box your order needs, and shown at checkout before you pay. See our Shipping Policy.
  • Offers, such as a set price for any three single stems, are applied automatically at checkout and shown before you pay. We may change or end an offer at any time, but never on an order you’ve paid for.
  • We may change prices at any time, but a change never affects an order you have already paid for.
  • If an obvious pricing error slips through, we may cancel the affected order and give you a full refund, and we’ll tell you why.

3. Placing an order

  • Your order is confirmed once your payment succeeds. We’ll send an order confirmation to the email address you provide.
  • Please make sure your name, email, phone number, and delivery address are correct — we rely on them to deliver your order.
  • In rare cases — for example if materials become unavailable — we may be unable to fulfil an order. If so, we’ll contact you and give you a full refund.

4. Payment

Payments are processed securely by our payment partner, Razorpay. We never see or store your full card or bank details; they are handled by Razorpay under its own terms and security standards.

5. Custom pieces

  • Custom pieces are sold at the fixed price shown at checkout for the type and size you choose, and are made to the brief you give us when ordering.
  • If your idea won’t fit the size you chose, we’ll get in touch before we start. You can then adjust your brief, or cancel for a full refund.
  • If part of your brief isn’t possible — a colour we can’t source, for example — we’ll get in touch before we start.
  • Because a custom piece is made specifically for you, differences of personal taste where it matches your brief are not grounds for a replacement or refund.

6. Delivery

We deliver within India only, usually within 7 daysof your order. Where we offer it, you can instead collect your order in Pune for free; we’ll message you the pickup point and time. Full details are in our Shipping Policy.

7. Cancellations, returns, and refunds

You can cancel within 24 hours of ordering. We do not accept returns, but we will replace items that arrive damaged or incorrect. Full details are in our Cancellation & Refund Policy, which forms part of these Terms.

8. Intellectual property

All content on the Site, including the designs, photographs, text, logo, and the Toto's Botanica name, belongs to us or our licensors. You may not copy, reproduce, or use it for commercial purposes without our written permission.

9. Acceptable use

You agree not to misuse the Site, provide false information, place orders you don’t intend to pay for, attempt to disrupt the Site, or use it to send spam or harmful content.

10. Third-party links

The Site may link to third-party sites (for example, social media). We are not responsible for their content or practices.

11. Limitation of liability

To the fullest extent permitted by law, our total liability for any order is limited to the amount you paid for it, and we are not liable for any indirect or consequential loss. Nothing in these Terms limits any liability that cannot be excluded under applicable law, including the Consumer Protection Act, 2019, or affects your statutory rights as a consumer.

12. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to your consumer-protection rights, the courts of Pune, Maharashtra shall have jurisdiction over any disputes.

13. Changes to these Terms

We may update these Terms from time to time. The “last updated” date above shows the latest version. The Terms in force when you placed an order are the ones that apply to that order.
